Sales and Manager's Agreement:

Hiring Agreement: Le Grand Window Cleaning, LLC. referred to as Le Grand Window Cleaning, and The person listed above, referred to as Salesperson / Manager agree: Salesperson / Manager shall perform 1 or more of the following services for Le Grand Window Cleaning: Sales City Sales Manager State Sales Manager Regional Sales Manager National Sales Manager Payment Details: Salesperson / Manager shall be paid on commission-based pay. Commissions shall be as follows: Salesperson: * $20.00 plus 15% of Gross Sale. * Recurring commissions per service: 1% of all sales. Sales Manager: * Sales Managers: 10.00 plus 10% of Gross Sale. *Recurring commissions per service: 5% of all down line sales. District Managers: * 7% of Gross Sale * Recurring commissions per service: 1% of all down-line sales. Regional Manager * 2% of Gross Sale * Recurring commissions per service: 1% of all down-line sales. National Sales Manager: * 1% of Gross Sale * Recurring commissions per service: 1% of all down-line sales. In certain multiple location sales situations, commissions may vary and be higher or lower due to giving customers special group rates in which case sales commissions will be agreed upon in advance. Commissions are subject to change if deemed necessary by Le Grand Window Cleaning in which case Salesperson / Manages shall be notified of change. Salesperson / Manager shall be paid on Net-30-day terms, however actual pay may vary if a customer delays payment of services. In this case, Salesperson / Manager shall be paid after the customer pays for services rendered. This agreement shall begin on the date at the bottom of this agreement and shall terminate 1 day after the last date of services rendered. Le Grand Window Cleaning reserves the right to terminate this contract on written notice to Salesperson / Manager for unsatisfactory performance of services, sales, lack of communication, unprofessional attitude or appearance, unethical reasons, or any reason deemed necessary by Le Grand Window Cleaning. In order to maintain a sound business structure and reputation. This is an agreement for independent contracting sales and or services. Le Grand Window Cleaning provides no benefits such as unemployment, insurance, health insurance or workers compensation insurance to Salesperson / Manager . Salesperson / Manager is responsible and liable for the cost of any damages or injuries caused by Salesperson / Manager or caused by the negligence of Salesperson / Manager. Le Grand Window Cleaning is only interested in the results obtained by Salesperson / Manager. Salesperson / Manager shall be responsible for providing all tools and materials required for performance of the tasks of the job. Salesperson / Manager is responsible for payment of all federal, state and local income taxes. Salesperson / Manager further agrees not to compete in any way with contracting party for a period of 5 years from the date of termination. This non-compete clause will not affect Salesperson / Manager’s personal or business cleaning contracts but only customers contracted by Le Grand Window Cleaning. In this case, Salesperson / Manager may do cleaning services, however may not use any of Le Grand Window Cleaning’s sales personnel, managers or service technicians. Salesperson / Manager agrees to keep all information regarding window cleaning, sales or service technician lists, sales persons or any level of management contact information, email addresses, phone numbers, and any other information regarding Le Grand Window Cleaning’s network of salespeople, managers and technicians, private. None of the above listed information including trade secrets and sales methods may be shared to any person, company or corporation for any reason. Salesperson / Manager agrees to keep all Le Grand Window Cleaning information and trade secrets confidential and private and shall in no wise share or use this information for personal gain outside of employment of Le Grand Window Cleaning Company. If Salesperson / Manager breaks this agreement, not to compete, Salesperson / Manager shall be liable for all court costs and attorney fees and necessary travel costs associated with the cost of enforcing this agreement. Le Grand Window Cleaning reserves the right to enforce this agreement using the laws and courts of the State of Kentucky. However, if necessary to file or settle legal action, dispute or suit outside the State of Kentucky in order to enforce this agreement, Salesperson / Manage will pay all legal costs, attorney’s fees, court costs and travel costs associated with enforcing such action.
